Regulamin korzystania z Newslettera e-point SA

§ 1. General provisions

  1. These Rules and Regulations of using the e-point SA Newsletter, hereinafter referred to as the "Regulations", specify the rules for the delivery service of the free newsletter of e-point SA with its registered seat in Warsaw (Company's address: ul. Filona 16, 02-658 Warszawa), NIP: 521-30-96-914, REGON: 016330363, entered into the register of entrepreneurs kept by the District Court for the Capital City of Warsaw, 13th Commercial Division of the National Court Register, under KRS number: 24163, with share capital in the amount of PLN 428,465 (fully paid up), tel. +48 22 853 48 30, hereinafter referred to as "e-point" or "Company".
  2. The service is provided to persons (hereinafter referred to as "Users") who have completed the registration form on the e-point website and thus subscribed to the list of people receiving the Newsletter.

§ 2. Subject of service

  1. The Newsletter is a service provided via electronic mail, on the terms set out in the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2019, item 123, as amended).
  2. The service consists of sending by e-point, to the e-mail address provided by the User, messages containing information about e-point’s services and activities, thematic information related to e-point’s activities, as well as other marketing and commercial information regarding e-point and companies affiliated with e-point.
  3. To order the Newsletter, the User fills in the form and then sends it electronically to e-point by clicking the "save" field. Clicking the indicated button will send the e-mail address provided to e-point and start the service. The service is provided after subscribing to the list of people receiving the Newsletter in this way.
  4. To use the Newsletter, it is necessary to have Internet access and an e-mail address as well as to have a standard operating system and a standard web browser.

§ 3. Terms and conditions of use

  1. The Newsletter service is free. 
  2. By subscribing to the Newsletter, the User accepts the Regulations.
  3. Users using the Newsletter are obliged to refrain from providing unlawful content, in particular in the scope of providing others’ data without the consent of authorized persons.
  4. The Newsletter is sent with a frequency determined by e-point.
  5. Individual messages sent as part of the Newsletter constitute pieces of work within the meaning of copyright and are subject to protection specified in law, in particular to protection under the provisions of the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 2019, item 1231, as amended). Any copying, modification and use in an inappropriate manner may constitute a violation of law.

§ 4. Duration of the contract

  1. The contract for the use of the Newsletter is concluded for an indefinite period.
  2. The User has the right to unsubscribe from the Newsletter at any time with immediate effect by sending a statement to the email address: marketing@e-point.pl or by post to e-point’s address indicated above.
  3. The Company may suspend or terminate the Newsletter service after informing Users to their e-mail addresses.
  4. The User has the right to withdraw from the contract within 14 days of subscribing to the Newsletter by sending a statement to the e-mail address: marketing@e-point.pl or by post to e-point’s address indicated above.

§ 5. Personal data and cookies

  1. The Company is the administrator of personal data processed to provide the service of using the Newsletter. Information on the processing of Users' personal data is available at https://www.e-point.pl/informacja-o-administratorze-danych
  2. Information about cookies is available at https://www.e-point.pl/ciasteczka

§ 6. Complaints and assertion of rights

  1. Complaints regarding the use of the Newsletter should be submitted to the email address: marketing@e-point.pl or by post to e-point’s address indicated above.
  2. e-point is liable for legal defects in accordance with applicable legal provisions.
  3. e-point considers the complaint within 14 days of its receipt.
  4. If the User is a consumer (a natural person performing a legal act not directly related to their business or professional activity), detailed information on the possibility of using out-of-court complaint consideration and redress methods, as well as the rules for accessing these procedures are available at the registered offices and websites of poviat consumer rights advisors, Voivodeship Inspectorates of the Trade Inspection and the Office of Competition and Consumer Protection: www.uokik.gov.pl.

§ 7. Final provisions

  1. Amendments to the Regulations may be introduced to the extent that they are permitted by applicable provisions. Amendments to the Regulations will be available on the e-point website. If the User does not accept the changes to the Regulations, they should immediately notify e-point.
  2. In matters not covered by the Regulations, the provisions of Polish law shall apply.
